Terms of Service — Speed Dating Social

In these Terms, the following definitions apply: "Speed Dating Social," "we," "us," or "our" refers to the operator of the Speed Dating Social service and website at speeddatingsocial.com. "You" or "your" refers to any individual who accesses our website, registers for an event, attends an event, or uses any of our Services. "Event" means any speed dating, singles mixer, or related event organised and hosted by Speed Dating Social. "Services" means our website, Eventbrite event listings, the Matching App 4.0, email communications, in-person events, and all related offerings. "Matching App 4.0" means the digital matching application used at Speed Dating Social events to facilitate anonymous match selection and the delivery of mutual match results. "Ticket" means a paid registration for a specific Speed Dating Social event, purchased through our website or Eventbrite. "Match" means a mutual selection made by two attendees through the Matching App 4.0, resulting in the disclosure of each party's contact details to the other. "Consumer" has the meaning given to it in the ACL.

2.1 Age requirement. Our Services are strictly available to individuals who are 18 years of age or older. By registering for an event or using our Services, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age at any point, including at the door of an event, and to refuse entry to any person who cannot satisfy this requirement. 2.2 Legal capacity. By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding contract under Australian law. 2.3 Accurate information. You agree to provide accurate, complete, and current information when registering for events or contacting us, and to update that information promptly if it changes. 2.4 One account per person. Each individual may only register for a given event once. Duplicate bookings or bookings made on behalf of another person without their knowledge are not permitted.

3.1 Registration process. To attend a Speed Dating Social event, you must complete a booking through our website or Eventbrite and pay the applicable ticket price. Your booking is not confirmed until payment is received and a booking confirmation is issued to your nominated email address. 3.2 Ticket prices. Ticket prices are listed at the time of booking and are subject to change. Early bird pricing is available for a limited period and is not retroactively applied to existing bookings. All prices are in Australian dollars (AUD) and inclusive of GST where applicable. 3.3 Age bracket selection. When booking, you must select the correct age bracket for your event. Events are structured around specific age ranges to ensure a comparable life-stage experience for all attendees. Misrepresenting your age to access a different age bracket constitutes a breach of these Terms and may result in refusal of entry without refund. 3.4 Payment processing. All payments are processed securely through Eventbrite or our third-party payment processor. Speed Dating Social does not store your full payment card details. Your use of Eventbrite's payment platform is also subject to Eventbrite's terms of service and privacy policy. 3.5 Booking confirmation. You will receive a booking confirmation email following successful payment. Please retain this confirmation as proof of your registration. We are not responsible for bookings that fail due to incorrect email addresses provided at the time of registration. 3.6 Event capacity. Events are capped at a fixed number of attendees to maintain a balanced gender ratio. Bookings are accepted on a first-come, first-served basis. We reserve the right to close bookings once capacity is reached.

4.1 No-refund policy. All ticket sales are final. Speed Dating Social does not offer refunds on tickets purchased for any reason, including but not limited to change of plans, personal circumstances, illness, or failure to attend. This policy exists to protect the experience of attendees who do show up — the event format depends on a balanced, committed group of participants, and cancellations directly and materially affect that experience. 4.2 Ticket transfers. Where you are genuinely unable to attend an event, ticket transfers are available subject to the following conditions: (a) You must submit a written transfer request by email to matches@speeddatingsocial.com — requests made via social media, direct messages, or any other channel will not be accepted or processed; (b) The request must be received at least seven (7) clear days before the date of the event; (c) The transfer must be to a specific named individual of the same gender and the same or equivalent age bracket as the original booking; (d) Transfers are to a specific listed future event — they are not open-ended credits and cannot be held indefinitely; (e) Transfers are assessed on a case-by-case basis and are not guaranteed. Speed Dating Social reserves the right to decline a transfer request at its discretion. 4.3 Selling your ticket privately. You may transfer your ticket to another eligible individual (same gender, appropriate age range) privately, subject to notifying us by email at matches@speeddatingsocial.com so we can update our attendance records. Speed Dating Social does not facilitate the private resale of tickets and accepts no responsibility for transactions made between private parties. 4.4 Event cancellation or rescheduling by Speed Dating Social. We reserve the right to cancel, postpone, or reschedule an event due to unforeseen circumstances, including but not limited to insufficient registrations, venue unavailability, public health directives, or events beyond our reasonable control. In the event of a cancellation initiated by us: (a) We will notify all registered attendees as promptly as reasonably practicable via the email address used at registration; (b) We will offer affected attendees either a full refund of the ticket price paid or a transfer to an equivalent future event at our discretion; (c) Speed Dating Social's liability in the event of a cancellation is limited to the face value of the ticket purchased and does not extend to any consequential costs incurred by the attendee, including but not limited to travel, accommodation, or childcare. 4.5 Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you may have under the ACL that cannot lawfully be excluded, restricted, or modified. If you are a Consumer within the meaning of the ACL, you may have statutory guarantees that apply to our Services regardless of these Terms.

5.1 Standard of conduct. By attending a Speed Dating Social event, you agree to behave respectfully, courteously, and lawfully towards all other attendees, hosts, and venue staff at all times. The spirit of our events depends on every participant feeling safe, comfortable, and genuinely welcomed. 5.2 Prohibited conduct. The following conduct is strictly prohibited at Speed Dating Social events and may result in immediate removal from the event without refund, and may result in you being banned from future events: (a) Any form of harassment, intimidation, bullying, discrimination, or threatening behaviour directed at any person; (b) Unwanted physical contact or behaviour of a sexual nature directed at any attendee or staff member; (c) Verbal abuse, offensive language, or conduct likely to cause distress to others; (d) Attending an event while intoxicated or under the influence of illicit substances; (e) Recording, photographing, or filming other attendees without their express consent; (f) Misrepresenting your identity, age, relationship status, or other material information to other attendees; (g) Any conduct that violates applicable law, including Commonwealth and state criminal law. 5.3 Removal from events. Speed Dating Social hosts reserve the right to remove any attendee from an event at any time where that attendee's conduct breaches these Terms or is otherwise disruptive to the safe and enjoyable operation of the event. Removed attendees will not be entitled to a refund. 5.4 No guarantee of matches. Speed Dating Social provides a structured environment for singles to meet in person. We do not guarantee that you will make a mutual match, form a connection, or enter into a relationship as a result of attending our events. Event outcomes depend entirely on the independent choices of individual attendees. 5.5 Attendance punctuality. Events commence promptly at the advertised start time. Late arrivals may not be accommodated where the rotation has already begun. We strongly recommend arriving 10–15 minutes before the scheduled start time. 5.6 Venue rules. In addition to these Terms, you agree to comply with all rules and requirements of the venue at which the event is held. Speed Dating Social accepts no liability for any loss, damage, or injury arising from a breach of venue rules.

6.1 Use of the app. The Matching App 4.0 is provided for use at Speed Dating Social events only. By using the app, you agree to these Terms and our Privacy Policy. 6.2 Match selection. Your match selections are submitted anonymously during and after the event. No other attendee can view your selections in real time. Mutual match results — where both parties have independently selected each other — are delivered to your nominated email address by 8:00 AM on the morning following the event. 6.3 Disclosure of contact details. By attending a Speed Dating Social event and using the Matching App 4.0, you consent to the disclosure of your name and email address to other attendees who have mutually selected you as a match. This disclosure is a core function of the Service and is not a breach of your privacy. You may limit this disclosure by choosing not to select any attendee as a match. 6.4 App availability. Speed Dating Social does not guarantee that the Matching App 4.0 will be available without interruption or error. In the event of a technical failure, we will take reasonable steps to manage the event and deliver match results by alternative means.

7.1 Our intellectual property. All content on the Speed Dating Social website and associated materials — including but not limited to text, graphics, logos, event descriptions, photographs, software, and the Matching App 4.0 — is owned by or licensed to Speed Dating Social and is protected by Australian and international intellectual property laws. 7.2 Limited licence to users. We grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use our website and Services for your own personal, non-commercial purposes only. This licence does not permit you to reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website or Services without our prior written consent. 7.3 User-submitted content. Where you submit content to us — including event feedback, reviews, or testimonials — you grant Speed Dating Social a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide licence to use, reproduce, modify, adapt, publish, and display that content in connection with the promotion and operation of our Services. You represent and warrant that you own or have the necessary rights to submit such content and that it does not infringe the rights of any third party. 7.4 Content standards. You agree not to submit any content that is false, defamatory, offensive, harassing, discriminatory, or in breach of any applicable law. We reserve the right to remove any user-submitted content that breaches these standards without notice.

8.1 Services provided as is. To the extent permitted by law, our Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. 8.2 Exclusion of consequential loss. To the fullest extent permitted by the ACL and other applicable law, Speed Dating Social, its officers, employees, agents, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services, attendance at our events, or any match or interaction arising from the Matching App 4.0 — including but not limited to loss of opportunity, disappointment, emotional distress, or any damages arising from interactions with other event attendees following an event. 8.3 Cap on liability. Where liability cannot be excluded, our total aggregate liability to you for any claim arising out of or in connection with these Terms or our Services is limited to the amount you paid for the ticket to the relevant event. 8.4 Third-party interactions. Speed Dating Social is not responsible for the conduct of any event attendee before, during, or after an event. Where you choose to pursue contact with another attendee following an event, you do so entirely at your own risk. We strongly recommend that any follow-up meetings take place in public locations. 8.5 ACL consumer guarantees. Nothing in these Terms excludes any guarantee, warranty, right, or remedy that cannot lawfully be excluded under the ACL. Where the ACL applies, our liability for a failure to comply with a consumer guarantee is limited, to the extent permitted, to the resupply of the relevant service or the cost of having the service supplied again.

You agree to indemnify, defend, and hold harmless Speed Dating Social and its officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our Services; (b) your attendance at any Speed Dating Social event; (c) your breach of these Terms; (d) your violation of any applicable law or the rights of any third party, including other event attendees; or (e) any content you submit to us.

Your use of our Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, store, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please review our Privacy Policy carefully before using our Services.

11.1 Eventbrite. Speed Dating Social uses Eventbrite as its primary ticketing platform. Your use of Eventbrite in connection with booking our events is subject to Eventbrite's own terms of service and privacy policy, over which Speed Dating Social has no control. We are not responsible for any acts or omissions of Eventbrite. 11.2 Third-party links. Our website may contain links to third-party websites. These links are provided for your convenience only. Speed Dating Social does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website. Your use of any linked website is at your own risk.

12.1 Good faith negotiation. If a dispute arises between you and Speed Dating Social in connection with these Terms or our Services, both parties agree to first attempt to resolve the dispute through good faith negotiation. Please contact us at matches@speeddatingsocial.com to raise your concern. 12.2 Complaints. We aim to respond to all complaints within 14 business days. Where a complaint relates to personal information, please refer to the complaint process outlined in our Privacy Policy. 12.3 Consumer dispute bodies. Nothing in these Terms prevents you from lodging a complaint with a relevant consumer protection body, including Consumer Affairs Victoria (consumer.vic.gov.au) or the Australian Competition and Consumer Commission (accc.gov.au), where you believe your rights under the ACL have been breached. 12.4 Governing law and jurisdiction. These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any dispute that cannot be resolved by negotiation, without limiting your rights under the ACL or any other applicable law.

13.1 Entire agreement. These Terms, together with our Privacy Policy and any event-specific terms communicated to you at the time of booking, constitute the entire agreement between you and Speed Dating Social in relation to your use of our Services and supersede all prior agreements, representations, and understandings. 13.2 Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed from the Terms and the remaining provisions will continue in full force and effect. 13.3 Waiver. A failure by Speed Dating Social to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. 13.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction. 13.5 Force majeure. Speed Dating Social will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, venue closures, or industrial action. 13.6 Notices. Any notices or communications required under these Terms should be sent to Speed Dating Social by email at matches@speeddatingsocial.com. We may send notices to you at the email address provided at the time of your event registration.

We may update these Terms from time to time to reflect changes in our Services, business practices, or applicable law. Updated Terms will be posted on our website with a revised "last updated" date. Where changes are material, we will take reasonable steps to notify registered users by email. Your continued use of our Services after updated Terms are posted constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must cease using our Services.
